People often argue over the issue and don't have a clue as to the facts. Sadly, many simply ignore the facts when those facts don't support their position. So, I'm putting up few facts and links for those that care and don't just bury their head in the sand..or elsewhere.

                                         
Illegal Immigration IS a Crime  Since 1929, illegal entry into the United States has been a federal crime, a misdemeanor. The penalty for a first offense is up to six months in jail or prison and/or a fine of $50 to $250.  Unauthorized reentry after being deported is a felony. "Unauthorized presence" is treated as a civil offense. Many people get confused about this.

Using False ID, SSNs, etc.. is a felony. I ran into this press release, dated 2006,  on a Kansas DOJ website. It concerns some illegals that were charged for a number of offenses associated with working here without permission, etc.. It, at least, should give you some idea of the law. I'll try to find some legal references later.

The penalties for convictions on the charges are as follows:

– Using false documents to be employed: A maximum penalty of 10 years without parole in federal prison and a fine up to $250,000.
– Making a false statement on an I-9: A maximum penalty of 5 years in federal prison without parole and a fine up to $250,000.
– Misusing a Social Security number: A maximum penalty of 5 years in federal prison without parole and a fine up to $250,000.
– Making a false claim of resident alien status: A maximum penalty of 5 years in federal prison without parole and a fine up to $250,000.
– Using false documents with intent to defraud the United States: A maximum penalty of 15 years in federal prison without parole and a fine up to $250,000.
– Possession of false United States documents: A maximum penalty of 15 years in federal prison without parole and a fine up to $250,000.
– Aggravated identity theft: A mandatory penalty of 2 years in federal prison to run consecutively to any other sentence, and a fine up to $250,000.
Immigration and Customs Enforcement investigated both cases. Assistant U.S. Attorney Brent Anderson is prosecuting both cases.

Census Figures. I'll try to find another source or, maybe, someone will send me one but the story goes like this: We allow more legal immigration than the rest of the world, combined!!! We have more immigrants in total numbers and are nearing an all time high for percentage of immigrants. "But you're slamming the door in immigrants' faces." Bullshit. I saw some survey from 2004 that put the all time high percentage at around 14%, not sure what year. This article says we're at 12.4%, now.  NYTimes
Over all, immigrants now make up 12.4 percent of the nation’s population, up from 11.2 percent in 2000. That amounts to an estimated 4.9 million additional immigrants for a total of 35.7 million, a number larger than the population of California.




This country reached a population of 200 million in 1967. Now, in 2006, we're about to hit the 300 million mark. And projections show we'll hit 400 million around 2050. (I think much sooner)  Somebody needs to hit the brakes!!

Total Numbers of Illegals:  Nobody knows. Guess-timates range from about 12-20 million.  A Time magazine report Sept. 2004 put the number of illegals coming in at 3 million a year. A new report is coming out that puts the numbers much higher.
This makes mention of 10 million illegals coming in last year.

Citing federal estimates that the Border Patrol apprehends only 10 percent to 30 percent of illegal crossers, the report said as many as 10 million illegal immigrants may have entered the U.S. last year.

In fairness, the same guy may be caught several times so that can inflate the numbers. Nobody really knows how many are crashing the border. They just take the number caught and guess that 3 or 4 got thru.

Illegal aliens are a net deficit    The results of a GAO study. In fairness, I haven't seen anything that I would consider without question mainly because there are so many factors to consider. But, as I said before, I'm not so fast to sell out any sense of right and wrong over a dollar. If someone has a more definitive study please send it.

Illegal immigration is a burden on the taxpayer.

The costs of illegal immigration to the taxpayer are numerous, but the largest costs are education of their children, emergency medical care and incarceration for those arrested for crimes. Despite being ineligible, some illegal aliens also get welfare the same way they get jobs: with identity documents falsely identifying them as U.S. citizens. In addition, if they have U.S.-born children, they may collect welfare assistance in the name of those children. The annual net cost of illegal immigrants (after subtracting their tax payments) to the American taxpayer is likely to be more than $45 billion. Our recent study of the net fiscal “Costs of illegal immigration to Californians” estimated the partial costs at $10.5 billion in that state alone.

Effects of Illegal Immigration

Health care:

 

-     In some hospitals, as much as two-thirds of total operating costs are for uncompensated care for illegal aliens. (Read more: The Sinking Lifeboat: Uncontrolled Immigration and the U.S. Healthcare System - Executive Summary FAIR)

-       The utilization rate of hospitals and clinics by illegal aliens (29 percent) is more than twice the rate of the overall U.S. population (11 percent).(Read more: Illegal Immigration and Public HealthFAIR)

-       Uninsured illegal aliens cost $2.2 billion annually to the health care system. (Read More: The High Cost of Cheap Labor Illegal Immigration and the Federal Budget, Center for Immigration StudiesCIS)

 

Education:

 

-       The total K-12 school expenditure for illegal immigrants costs the states nearly $12 billion annually, and when the children born here to illegal aliens are added, the costs more than double to $28.6 billion.(Read more: Breaking the Piggy Bank: How Illegal Immigration is Sending Schools Into the RedFAIR)

Crime
  These are just a few snippets from a Congression hearing.

*It is also apparent that aliens are members of many of the most violent gangs in America. Reports have indicated that 60 percent of California's 18th Street Gang are illegal aliens.


*Some have asserted that temporary protected status, or TPS, has also protected alien gang members who would have otherwise been deportable. In January, the Government announced an 18-month extension of TPS for El Salvador, the home country of many MS-13 members currently in the United States. The Subcommittee has been told that two of the three alleged MS-13 members charged in the 2002 rape of two deaf girls in Massachusetts had applied for TPS prior to that attack, and that one was actually granted that relief.


*As Mr. Garcia told us, nobody knows for certain the percentage of illegal aliens in gangs, thanks in part to sanctuary laws that forbid local police from even inquiring into a criminal's immigration status. But there's a few numbers that I think are suggestive.

 In Los Angeles, 95 percent of all outstanding warrants for homicide target illegal aliens, and approximately two-thirds of all felony outstanding warrants target illegal aliens. ICE says Mara Salvatrucha is predominantly or majority illegal. Police officers will tell you it's basically 100 percent illegal. He mentioned the 18th Street Gang or you mentioned the 18th Street Gang, which a California Department of Justice study put at about 60 percent illegal. Again, cops will say otherwise.


*In late 2002, four illegal Mexicans brutally abducted and gang-raped a 42-year-old mother of two near a railroad in Queens, New York. Three of these illegal rapists had been arrested numerous times for assault, attempted robbery, criminal trespass, illegal gun possession. But pursuant to New York's sanctuary policy, the police had never notified the INS.

 In Los Angeles, 5 months ago, Carlos Barrera, an illegal Mexican, mugged three people, burglarized two apartments, and attempted to rape a 5-year-old girl. He had been deported 4 years ago for crimes of violence but, of course, had reentered. Since his reentry, he had been stopped twice for traffic violations. But, again, the cops never notified ICE because of L.A.'s sanctuary policy.



More Crime      This is from a small survey of illegals in custody.

The briefing slides in enclosure I address each of our three questions. 
In summary, for our study population of 55,322 illegal aliens, we found 
that:

* They were arrested at least a total of 459,614 times, averaging about 
8 arrests per illegal alien. Nearly all had more than 1 arrest. Thirty-
eight percent (about 21,000) had between 2 and 5 arrests, 32 percent 
(about 18,000) had between 6 and 10 arrests, and 26 percent (about 
15,000) had 11 or more arrests. Most of the arrests occurred after 
1990. 

* They were arrested for a total of about 700,000 criminal offenses, 
averaging about 13 offenses per illegal alien. One arrest incident may 
include multiple offenses, a fact that explains why there are nearly 
one and half times more offenses than arrests.

I could go on and on about the amount of crime by illegal aliens. It's mind-numbing. And much worse are the times an illegal is caught and released only to reoffend and not be deported. There is no excuse. And some Americans pay for this insanity with their lives.

For those that want to say it's the republicans that favor an amnesty.

But in Congress's rush to recess last night for the fall political campaigns, the fence bill passed easily, 80 to 19, with 26 Democrats joining 54 Republicans in support. One Republican, Sen. Lincoln D. Chafee (R.I.); one independent, Sen. James M. Jeffords
(Vt.); and 17 Democrats opposed the bill.

In fairness, this isn't a partisan issue even though more democrat politicians are weak-kneed about it. The people of all political stripes feel about the same. And there are democrats like my Congressman, Jim Marshall, who voted to make unauthorized presence a felony and is opposed to any amnesty.

But it's just poor Mexicans looking for a better life.

Last year, only 25 percent of the 160,000 OTMs caught were deported, while the rest were released into the country, according to U.S. Customs and Border Protection. Illegal immigrants who made it here shared information of the practice with friends overseas, many of whom also followed suit.



In 2005, the largest group of OTMs migrated from Honduras. More than 36,000 were caught in the first six months of the year. Brazilians were second, with 27,300 for the same time period. The rest of the OTMs taken into custody were mostly from Central American countries. But immigrants from China, Iraq, Canada, Peru, India, Israel, Pakistan and Cuba were also on the list.

OTMs means "Other Than Mexicans." Also, if I remember correctly, think it was in the Pew study, most Mexican illegals had jobs in Mexico. So the "What are they supposed to do, stay there and starve" argument doesn't cut it. Found a reference: Link

Only 5 percent of the 4,836 migrants surveyed were unemployed in Mexico before moving to the United States - a significantly lower number than in past studies and theories about migrants, Suro said.



Where They Come From:

According to a new report from the Pew Hispanic Center, an estimated 10.3 million illegal immigrants lived in the United States as of March 2004. The majority are from Mexico and other Latin American countries. Source: Pew Hispanic Center.   Link

It's evil corporations that are responsible.  While I'm thinking about it, there are plenty of people that repeat that line. No doubt, some corporations do hire and exploit illegals but guess what? Plenty of mom and pop businesses, also, use them. Who's the biggest offender, I don't know. But don't fall for that line. Or the "It's because of NAFTA." Fact is that there were millions of illegals coming in before NAFTA. Yeah, it might have made it worse but...

-- Illegal immigrants can be found working in many sectors of the U.S. economy. About 3 percent work in agriculture; 33 percent have jobs in service industries; and substantial numbers can be found in construction and related occupations (16 percent) and in production, installation and repair (17 percent).

"But how is the employer supposed to know? They had the right documents."

The US stole that area from Mexico.       
In a word, "Wrong."

The war was terminated with the Treaty of Guadalupe Hildago where the United States purchased the mostly vacant northern territories for $15 million.

That was in 1848. The US also assumed about 3 million in claims citizens had against Mexico. The Gadsden Purchase came in 1853 for an additional  10 million dollars. That adds up to 28 million dollars. As a point of reference: The Lousiana Purchase was for 15 million in 1803. Mexico won their independence from Spain in 1821. So, Mexico only owned those territories for 27 years.

Texas won its independence from Mexico following the Battle of San Jacinto in 1836. Texas has the unusual honor of having been part of six different countries: France, Spain, Mexico,  The Republic of Texas, the Confederacy, and the United States.

                                                              



But a Fence won't do any good. 
I mentioned the Fence on pg.2. But this video clip can give you some idea of the amount of crime and problems associated with a border that has little protection. The truth is: If this country has the will it can dramatically cut the number of illegals crossing the border. Whether through barriers, sensors, manpower, whatever.  I don't think a "Fence" is going to solve the problem.

AUSTIN - A crackdown on illegal border crossings has produced a "stunning" reduction in crime for 27 Texas counties, Gov. Rick Perry said Tuesday.

"Borderwide, we experienced an average crime reduction of 60 percent because of intensive operations under Operation Rio Grande," Perry said of the border security effort.
